1. About the Tarbell Charitable Trust

The Tarbell Charitable Trust (TCT) is a private, tax-exempt 501(c)(3) nonprofit organization incorporated in the United States. TCT is the organizing body behind The Tarbells: Celebrating Our Mohawk and American Story exhibition and all related programs, publications, events, and grant initiatives. 2. Website Use & Intellectual Property

2.1 Acceptance of Use

By accessing and browsing tarbellcharitabletrust.org (the "Site"), you accept and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please discontinue use of the Site immediately.

2.2 Permitted Use

You may use this Site for lawful, personal, and non-commercial purposes only. You agree not to:

– Copy, reproduce, distribute, or publicly display any Site content without prior written permission from TCT.

– Use any automated tool, scraper, or bot to access, crawl, or index the Site.

– Attempt to gain unauthorized access to any portion of the Site or its underlying systems.

Images of artworks by Edmund Charles Tarbell and the commissioned Tarbellite artists are reproduced with permission. Reproduction or use of any artwork image for any purpose other than personal, non-commercial reference is strictly prohibited without written consent from TCT and, where applicable, the individual artist or their estate.

2.4 Third-Party Links

The Site may contain links to third-party websites (including artist websites and institutional partners). TCT is not responsible for the content, privacy practices, or accuracy of any third-party site. The inclusion of any link does not constitute an endorsement.

2.5 Disclaimer of Warranties

The Site and its content are provided on an "as is" and "as available" basis. TCT makes no warranties, express or implied, regarding the accuracy, completeness, or fitness for any particular purpose of any content on the Site. TCT reserves the right to modify, suspend, or discontinue the Site at any time without notice.

3. Exhibition Ticket Purchases & Refunds

3.1 Ticket Sales

Tickets to The Tarbells exhibition, opening and gala events, and any associated lectures, tours, or programs may be purchased through the Site or authorized third-party ticketing platforms. All prices are listed in U.S. dollars. Payment is due in full at the time of purchase. TCT accepts major credit cards and such other payment methods as may be indicated at checkout. By completing a purchase, you represent that you are authorized to use the payment method provided.

3.2 Refund Policy

TCT's standard ticket refund policy is as follows:

– Cancellation 14 or more days before the event: full refund, less any applicable processing fee.

– Cancellation 7–13 days before the event: 50% refund.

– Cancellation fewer than 7 days before the event: no refund. Tickets may be transferred to another individual at the purchaser's discretion.

– If TCT cancels or postpones an event, ticketholders will receive a full refund or the option to apply their purchase to a rescheduled date.

3.3 Gala & Live Auction Events

Gala and live auction events are subject to additional terms that will be provided to ticket purchasers at the time of registration. Auction participation constitutes a binding offer to purchase. All auction sales are final. TCT reserves the right to withdraw any lot from auction at any time prior to the fall of the hammer.

3.4 Accessible Accommodations

TCT is committed to making exhibition and event experiences accessible to all guests. Requests for accommodations should be submitted no fewer than fourteen (14) days in advance of the event to allow adequate preparation.

4. Donations

4.1 Charitable Donations

The Tarbell Charitable Trust is recognized as a tax-exempt organization under Section 501(c)(3) of the Internal Revenue Code. Contributions may be tax-deductible to the extent permitted by applicable law. Donors should consult their own tax advisors regarding the deductibility of any gift. Donations made through the Site are processed securely. TCT does not store full payment card information. By submitting a donation, you:

– Represent that you are the authorized owner of the payment method used.

– Understand that all donations are final and non-refundable except as required by law.

– Acknowledge that TCT retains full discretion over how donated funds are applied in furtherance of its charitable mission.

Donors wishing to designate a gift for a specific program (e.g., the Ase Tsi Tewathon–Kanien'kéha Language Program, artist commissions, or exhibition production) should indicate this in writing at the time of donation. TCT will make reasonable efforts to honor such designations, but retains discretion to redirect funds if operational circumstances require.

4.2 Donor Recognition

TCT may publicly recognize donors in exhibition catalogs, on the Site, and at events unless the donor requests anonymity in writing at the time of the gift.

5. Photography & Media Rights at Events

5.1 TCT's Media Rights

TCT and its authorized photographers, videographers, and media partners may photograph, film, or otherwise record all TCT events, including the Exhibition, galas, lectures, and community programs. By attending any TCT event, you acknowledge and consent to being photographed or filmed as part of a crowd or general event documentation. TCT may use such images and recordings for editorial, promotional, archival, and educational purposes without additional compensation or consent.

5.2 Individual Portrait Subjects

Individuals who participate as named portrait subjects in connection with the Exhibition (including members of the Mohawk Tarbell and colonial Tarbell families) will be asked to sign a separate Portrait and Likeness Release Agreement. Nothing in these Terms constitutes consent to use a named individual's portrait commercially without such a separate written release.

5.3 Guest Photography

Guests attending TCT events and the Exhibition may take personal, non-commercial photographs subject to the following restrictions:

– Flash photography and tripods are prohibited in the Exhibition galleries without advance written permission from TCT.

– Photography of artwork in the Exhibition is permitted for personal use only. Any reproduction, publication, or commercial use of photographs depicting exhibited artworks requires written permission from TCT and, where applicable, the individual artist or their estate.

– Photographs that include identifiable individuals may not be published or shared on social media without the consent of those individuals.

– TCT reserves the right to restrict or prohibit photography in specific areas or during specific programs at its sole discretion.

5.4 Press & Media Credentialing

Members of the press and media seeking to photograph, film, or broadcast TCT events

must obtain advance press credentials from TCT's designated communications

contact. Credentialed media agree to use any images or recordings in a manner

consistent with editorial fairness and TCT's approved messaging guidelines for the

Exhibition. TCT reserves the right to review and request correction of factually

inaccurate reporting or captions.

5.5 Artwork Image Licensing

High-resolution images of artworks in the Exhibition are available for licensing through TCT for editorial, educational, and institutional purposes. Inquiries should be directed to TCT's communications contact. Commercial licensing of artwork images is subject to separate written agreement and may require the consent of the individual artist or their estate.

6. Privacy

TCT's collection and use of personal information provided through the Site or in connection with TCT programs is governed by TCT's Privacy Policy, which is incorporated herein by reference and available at tarbellcharitabletrust.org/privacy. By using the Site or participating in TCT programs, you consent to the data practices described in the Privacy Policy.

7. Limitation of Liability

To the fullest extent permitted by applicable law, TCT, its trustees, officers, employees, volunteers, and contractors shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Site, attendance at any TCT event, participation in any TCT program, or reliance on any content published by TCT. TCT's total liability for any claim arising under these Terms shall not exceed the amount actually paid by you to TCT in connection with the transaction giving rise to the claim.

8. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration administered under the rules of the American Arbitration Association, with proceedings conducted in Middlesex County, Massachusetts, unless the parties mutually agree otherwise. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending the outcome of arbitration.

9. Modifications to These Terms

TCT reserves the right to modify these Terms at any time. When we do, we will revise the "Last Updated" date at the top of this page. We encourage you to review these Terms periodically. Your continued use of the Site or participation in TCT programs after any modification constitutes your acceptance of the updated Terms.
